Omih Binti Saanen is a women worker of PT. Panarub Dwikarya-Adidas and  Mizuno shoes factory in Main Benoa St, Benoa Mas Complex, Block B, No: 1, Pabuaran Tumpeng Kota, Tanggerang, Banten. 

PT. Panarub Dwikarya (PDK) is a company that produce footware, esthablised in 2006 and start the production on 2007. PDK company is part of Panarub Group which composed from PT. Panarub Industri, PT. Panrub Dwikarya Benoa and PT. Panarub Dwikarya Cikupa. Until today PDK Company employed not less than 2560 workers, where the majority, 90 percent of them are womens. This company, that being led by Hendrik Sasmita, is produce footware for famous brand like Adidas (subcontract from PT Panarub Industri), Mizuno (50 percent) and Specs (25 percent).

Omih work in PT Panarub Dwikarya since 18 March 2009 in assembling unit as operator in cell4 with emloyment no: 20090300460. Omih born in Tangerang on March 17th, 1984, as second children from 6 brothers, her parent are Saanen and Fatmawati . Omih married once, and had one daughter. Her daughter died because illness (2 years old), because Omaha couldn’t take care of her since she was never been given permission from the company, though during that time, the doctor already given notice that her daughter is in the hospital for medication. Omih officially divorced with her husband since 2011, during her marriage she often become victim of domestic violence, and abuses from her alcoholic and jobless husband.

Omih binti Saanen, is registered on April 2012 as a member of Textile, Garment and Shoes-Federation of Independent Trade Union (Serikat Buruh Garmen Tekstile dan Sepatu – Gabungan Serikat Buruh Independen (SBGTS- GSBI) in PT . Panarub Dwikarya, that was declared on February 23rd 2012.

On July 2012, not less than 2000 workers of PT. Panarub Dwikarya, that are bening member of Serikat Buruh Garmen Tekstile dan Sepatu – Gabungan Serikat Buruh Independen (SBGTS- GSBI) launched strike to demand for the application of 2012 minimum wage level for January-March 2012 that has not been paid by the company, the workers demand holyday allowances and hire back of union chairperson and secretary of SGBTS-GSBI that are being fired by the company also. The strike was launched to demand improvement on working condition in PT. Panarub Dwikarya. From this strike PT. Panarub Dwikarya seeing these 1300 workers are resigns from their employment.

During the last strike, thousands of workers PT. Panarub Dwikarya who are mostly women should receive various forms of violence, whether perpetrated by corporate security forces, the police and hired thugs organized by the management company.

OMIH, 28 year old, is one of the workers involved in the strike. OMIH felt called to be actively involved in the strike action because, she obviously having a very bad treatment from the company. In 2010, OMIH had lost his son who died of illness. Ironically, the company did not give permission to leave for Omih to take care her children who are sick, even when Omih shown a letter stating that her son was having serious illness..

Since the occurrence of workers spontaneous protests (strikes) at PT. Panarub Dwikarya on July 12, 2012, which resulted in a total stop the production process, OMIH very active in the organizing work and also participate in various activities of the organization.

Because of her activity since the date of July 19, 2012 OMIH trusted by the organization and the friend’s apartment to serve as Deputy Regional Coordinator (Area Coordinator) for Region Sepatan. In charge of five (5) Coordinating Group (Cord Group) with each group to organize and lead (composed) 10 to 15 workers (union members). Since the workers are no longer allowed to come to work, to facilitate the consolidation and dissemination of the various developments of the struggle Organization decided to form collectives work by region and residence. Until now SBGTS-GSBI Area Coordinator PT PDK had 16 and 76 Groups. Since served as the Deputy Area Coordinator SBGTS-GSBI PT Panarub Dwikarya for Region Sepatan, almost every day, Omih going around visiting friend’s house in each Group. And be sure, on every Saturday and Sunday OMIH become resource person in some group discussions that are under her responsibility. until today, Omih,  is struggling along with 1,300 shoe factory workers Adidas and Mizuno PT Panarub Dwikarya (PT PDK) for reinstatement and payment of rights declared a unilateral termination of the date of July 18, 2012 .

On Saturday, September 29th, 2012 at 13:00 PM, OMIH being arrest by the Police from Tangerang City Police with Terrorists Allegations (violation of Article 336 of the Criminal Code and article 27 or article 45 paragraph 4 Jo paragraph 1 of Act No. 11 of 2008 on Information and Electronic Transaction) based on the company report to the police, with the Police Report Number: TNG LP.B/941/IX/2012/PMJ/Restro City dated 14 September 2012, its just because on the date 14 September 2012 OMIH send a short message (SMS) to two (2) people on the management (Edy Suyono / as Manager HRD and Guan an / as Production Manager) and five (5) coworkers (Yani, Ita Lestari, Eli Ruth Patmini, Siti Nurjanah, Muria) which is currently still working in the company,  its contents said: “Be careful for those who are still in PDK, tonight being assembled bombs to blow PDK tomorrow”. 

According OMIH, no genuine intention when the message is sent, purely because of a flood of emotions and disappointments that are not able to be stopped on the companies that continue to doing arbitrary  treatment to the workers . OMIH honestly say this idea came spontaneously just because her emotion, which has been very patient to not confront the management that always treat workers in bad way. “What we found, our demands never respond, even peaceful demonstrations that we do are always confronted with the mercenary company (thugs) and we always been banter by the management with abusive words.”

 “I (OMIH) and workers still struggling to survive because we want to change the way management treats their workers in order not arbitrarily. Like asking for leave that always been complicated, though its labor rights and that make me disappointed. When I was in 2010, I am asking for leave to my supervisor (Mrs. Junari Section Head Cell 4) because my son was sick at the time, I need to take him for medication. Until my children died, I was not given permission to leave, they tell because ” the reason always to take care a sick children”  though then there was a letter from Children’s Hospital I was in hospital. ” Before she arrested at his home on Saturday, September 29, 2012. After the incident the police are trying to find OMIH and several times the police came to the village where Omih with various reasons, they went to the house OMIH, RT and RW came to ask about OMIH.

On 28th September 2012, Friday, Omih house was been visited again by a group of police officer. Without showing identity and warrant letter, they search the house and omih bed room, while the other interrogated Omih family members with disrespectful manner , shouting when they are asking several questions, to find out where is Omih about. Since, 29th September 2021, Saturday, imih is under investigation at Tangerang Resort Police Office, to face interrogation.

Since in the beginning, before the interrogation process (BAP), the police olready been informed that Omih already appointed a lawyer from Jakarta Legal Aid, from interrogation process and signing the docemunet, Omih always ask to be accompanied by her lawyer but the police keep purse with the legal process.

 OMIH alleged to Article 336 of the Criminal Code and Article 27 paragraph 4 junto 45 and paragraph 1 of Law Number 11 of 2008 on Information and Electronic Transactions contents reads: Article 336 (Criminal Code):

(1). Punishable with a maximum imprisonment of two years and eight months. he who threatened violence against people or property outright to power together with a common crime that poses a danger to the security of people know stuff with rape or an act that violates decency to honor the life of a crime with severe mistreatment or by burning.

(2). When a threat is made in writing and with certain conditions it imposed maximum imprisonment of five years.

 

Article 27 paragraph (4) Law no. 11 of 2008 on Information and Electronic Transactions (ITE):

reads as follows: “Any person intentionally and without right to distribute and / or transmit and / or create inaccessibility of Electronic Information and / or Electronic Document which has a charge of extortion and / or threatening.”

 

The threat of criminal sanction of Article 27 paragraph (4) the ITE Law in accordance with Article 45 paragraph (1) of ITE is imprisonment of six (6) years and / or a maximum fine Rp.1.000.000.000 (one billion dollars).
